Child Custody includes any case where minor children are involved – the Court must determine custody and visitation rights for the parents.  In cases where the parties are resolving their case by agreement, such as an uncontested divorce, the Court still must make sure that the resolution promotes the best interests of minor children.

In Mobile, juvenile court has specific jurisdiction over certain types of family law cases.  If child custody is an issue and the parents have never been married, those cases are heard and decided in juvenile court. If the person filing for custody is not the biological parent of the child, this is called a dependency case, which typically means child abuse and/or neglect is involved.  These types of cases are heard in juvenile court as well.
